Protect your property investment

Property investment is only profitable and worthwhile if the tenant is paying the rent. It is therefore essential that a tenant should occupy your property on your terms. It is imperative that your rights are protected. Your investment property is simply too valuable to take chances with.

Each year landlords are writing off millions of pounds in rent and finding themselves stuck with bad tenants in their property. Why? Because their tenancy agreement did not fully protect their rights.

One of the most common mistakes a landlord makes is taking an off the shelf tenancy agreement and signing the tenant (usually a stranger) up to it. Be aware, even letting agents get it wrong. Ask them to explain your rights and invariably they will not be able to.

At the end of the tenancy, the tenant is legally allowed to remain in the property until such a time that an appropriate notice is served. If the tenant has continued to pay rent this will involve the tenant being served with a ‘section 21 notice’ But a 'section' 21 is only valid if the deposit is in the government scheme giving not less than 2 months notice to leave the property.

If the tenant hasn’t paid the rent, then depending on your circumstances a section 8 notice might be more appropriate. This notice simply gives the tenant 14 days to pay or face eviction.

The service of the correct notice is in all cases and without exception an essential legal pre-requisite if a landlord is to get his/her property back. Without it, all further stages will fail and a court will not grant an order for possession.
